Terms & Conditions

These terms and conditions supersede and exclude all prior and other discussions, dealings, representations and arrangements relating to the use of the Site and/or the supply of goods by Sarah McNally Bespoke Cakes.

Any failure on the part of Sarah McNally Bespoke Cakes to exercise or any delay in exercising any right, power or remedy pursuant to these terms and conditions does not operate as a waiver. If any term of these terms and conditions is unenforceable or invalid, such term(s) will be severed and the remaining terms will continue to bind the parties.

We reserve the right, at our complete discretion, to change these terms and conditions at any time by posting revised terms on the Site. It is your responsibility to check periodically for any changes we may make to these terms and conditions. Your continued use of this site following the posting of changes to these terms and conditions means you accept the changes.

 

Payment Terms

For celebration cakes, we must receive the balance 7 days prior to the delivery or collection date. For weddings, a £100 booking deposit is required to secure your date, with the final balance payable three weeks before your wedding date.

A contract between you and Sarah McNally Bespoke Cakes is only formed when we receive your payment and send you a confirmation email that your order and payment has been received and accepted.

Quotes

Quotes given are valid only for 30 days from when the quote was provided. We reserve the right to amend the quote as and when required. 

 

Cancellations

Deposits made by clients are strictly non-refundable. We highly recommend all clients take out wedding insurance prior to booking any wedding service.

Cancellations must be made prior to final payment date, otherwise full and final payment will still be required.

We reserve the right to cancel orders at any time. Payments already made by the client will be refunded in full should we cancel the order. 

For online orders, we reserve the right to cancel any order made and will offer a full refund to the customer where we need to cancel. Cancellations of online orders made by the customer no less than 7 days before the order is posted or collected will be offered a full refund. Where cancellation occurs within 7 days prior to posting or collection date, no refund will be given.

 

Changes to Your Order

The date of your final payment is the final date for any changes of size, style or flavours of the cake. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.

 

Delivery, Set Up & Care

Where applicable, delivery and setup is dependent on the location of the venue and will be stipulated in the final price.

We are not responsible for any damage to the cake after setup, delivery, or collection is complete. Cakes are heavy and require a sturdy table, and optimal room temperature of 20 degrees Celsius or below.

If you or your representative elects to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves our possession. Any consequence to the product as a result of the client or a representative not being available at the agreed time and location is the responsibility of the client.

 

Inedible Decoration & Flowers

Non-edible items may be used as decorations or packaging for the products. It is the client's responsibility to ensure that any non-edible items are removed prior to consumption. 

If flowers are provided by an outside source, you acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.

 

Photography

We may photograph our cakes and we reserve the right to use any photographs taken.

Allergens

Any allergies must be specified at the time of booking. Whilst every effort is made to avoid cross contamination we cannot guarantee this.

We cannot guarantee that our products are free from or did not come into contact with cereals containing gluten (such as barley, wheat and oats), eggs, lupin, milk, peanuts, sesame, soya, sulphur dioxide, sulphites and tree nuts.

You agree to notify your guests of this risk and hold us harmless for allergic reactions.

 

Force Majeure

Neither we, nor any delivery service that we use shall be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public road, riot, government act, act of war, terrorism, epidemic or from any industrial dispute or strike whatsoever.
